This Specialisation Course is designed for national lawyers, in-house counsel, and international legal practitioners appointed to defend clients in cases concerning data- and privacy-related violations, providing training on litigation related to national and transnational crimes, and large-scale cases affecting fundamental rights to privacy. The United Nations, the Council of Europe, the European Union, but also individual States are at the fore of this global effort to arrest the proliferation of sources of threats and attacks to privacy. There are many examples that demonstrate the varied aspects of this complex and rapidly expanding legal environment: the jurisprudence of the Court of Justice of the EU in the so-called Google Spain case and the connected emergence of the “right to be forgotten”; the so-called Facebook case that has led to the cessation of the EU-US Safe Harbour Agreement forcing the EU and the US to renegotiate the Privacy Shield Agreement; and the recently adopted EU General Data Protection Regulation (EU GDPR) which will enter into force in June.
This Course will be dedicated to the analysis of international and national regulations related to the subject matter, the legal tools of competent bodies, and the defence techniques in these cases with particular attention to the procedural aspects of international legal cooperation in criminal matters. Recent experience suggests that the respect and promotion of privacy and sensitive data requires effective protection mechanisms and procedures that are of great importance to lawyers and law firms.
