This intensive one-week Specialisation Course is intended for national lawyers, in-house counsel and international legal practitioners who defend clients in national and international jurisdictions on the basis of legal principles derived from the European Convention for Human Rights, and the European Court of Human Rights’ jurisprudence.
The Course provides participants with a solid foundation for understanding when and how the European Convention on Human Rights applies in their cases, and consequently for the preparation and submission of complaints before the Court. With frequent reference to caselaw and relevant national jurisdictions’ decisions, the Course will primarily concentrate on the different procedures under the Convention, namely its:
(a) individual complaint procedure;
(b) advisory jurisdiction;
(c) pilot judgment procedure; and,
(d) the execution of judgments within the scope of the Convention.
Through case studies, the Course introduces the basic principles and methods of interpretation applied by the European Court of Human Rights.
The Course comprises several modules: (1) the system of protection established by the European Convention of Human Rights, and the defence rights proclaimed by the Convention; (2) the various proceedings in front of the European Court of Human Rights; (3) individual complaints and the protection of rights in the administrative law field; (4) individual complaints and the protection of rights in the criminal law field; (5) individual complaints and the protection of rights in the civil law field; (6) the access to open sources and databases related to the Convention and the Court’s jurisprudence; and, (7) the effects of the Court decisions on domestic jurisdictions and the execution of sentences.
The participants will be guided in the process of making an application in front of the Court, with daily sessions dedicated to this practical exercise.
